§ 1 Scope
- These General Terms and Conditions (GTC) apply to all contracts between Monica Galletti, Rubedo Spa, Marienstraße 58, 32427 Minden (hereinafter “Rubedo Spa” or “we”) and our customers (hereinafter “Customer” or “you”) relating to wellness services, cosmetic products, food supplements, genome-based analyses and products custom-made according to genetic profiles, vouchers and associated consultancy services.
- We do not recognise any deviating terms and conditions set by the customer unless we have expressly agreed to their validity in writing.
§ 2 Conclusion of the contract
- By booking an appointment (online, by telephone or by email) or ordering a gift voucher, you are making a binding offer to enter into a contract. The contract is concluded upon receipt of our booking confirmation (by email or verbally on site).
§ 3 Prices and Payment
- All prices quoted are in euros and include statutory value-added tax (VAT), where applicable. Certain services may be exempt from VAT under Section 4(14) of the German Value Added Tax Act (UStG); in such cases, the price shown is the final price.
- Payment is made immediately after the treatment, on site, in cash or by card.
- Vouchers are valid for three years from the date of issue (Section 195 of the German Civil Code (BGB)). The full value of the voucher will be credited upon redemption; cash redemption is not permitted.
§ 4 Booking, cancellation and rescheduling
- Appointments for individual treatments that do not require personalised preparation may be cancelled or rescheduled free of charge up to 48 hours before the agreed appointment time. In the event of a later cancellation or a no-show, 50 per cent of the agreed service price will be charged as a cancellation fee, unless the customer can demonstrate that there was an obstacle beyond their control or that the loss incurred was minimal or non-existent (for example, because the slot could be reallocated to another client).
- Individually tailored services require specific preparatory work: prior to the appointment, the sequence of events, breathing and movement guidance, selection of sounds and music, and the materials used are designed and compiled specifically for the client. This preparation regularly takes several hours and is carried out in full before the agreed appointment. It is covered by the preparation fee and is deemed to have been provided once the work is completed; the fee is therefore non-refundable in the event of a subsequent cancellation. As a gesture of goodwill, we will credit the full amount if the session is rescheduled within 14 days.
- For treatments prepared individually for a specific appointment, the free cancellation period is 7 days. In the event of a later cancellation, we will charge 50 per cent of the service price, provided the slot cannot be reallocated; the customer reserves the right to prove that no damage, or only minor damage, has been incurred.
- For guided individual sessions of the Origo dimension (breathing and deep relaxation sessions), prepared and composed individually for the client, the following applies: an agreed session may be cancelled or rescheduled free of charge up to 24 hours in advance; for later cancellations, 50 %, and for a no-show without cancellation, 100 % of the session price is charged as a cancellation fee. The client remains entitled to prove that no loss or a lesser loss has occurred. Clause 2 applies accordingly to the associated preparation service; the preparation fee paid is credited in full (100 %) if a session is booked within 14 days.
- In the event of cancellation by Rubedo Spa (e.g. due to the therapist’s illness), an alternative appointment will be offered or the amount already paid will be refunded in full.
Why we do it this way: The Rubedo Principle
§ 5 Right of withdrawal (distance selling)
- If a contract — in particular for a voucher, a genome-based analysis or products custom-made to your profile — is concluded via distance selling (online, by email or by telephone without simultaneous physical presence), a statutory right of withdrawal exists in accordance with Section 312g of the German Civil Code (BGB) for a period of 14 days from the conclusion of the contract.
- The right of withdrawal expires prematurely for bespoke products as soon as production has commenced and the customer has given their express consent (Section 312g(2)(1) of the German Civil Code (BGB)). In the case of services — including genome-based analysis and its evaluation — this right expires once we have fully performed the service and the customer has given their express consent prior to commencement and confirmed their awareness of the expiry of the right (§ 356(4) BGB).
- The full cancellation policy forms part of these Terms and Conditions and is set out below.
§ 6 Scope of Services, Advice & Liability
- Rubedo Spa is a wellness and beauty studio. We provide exclusively wellness and cosmetic services; we do not offer any medical or therapeutic services. Our services are not a substitute for medical treatment and are not intended for the diagnosis, cure or prevention of illnesses.
- A personal consultation and medical history discussion takes place before each treatment. The client is obliged to provide truthful information and to disclose, of their own accord, any health conditions that may preclude treatment — in particular pregnancy, cardiovascular diseases, high blood pressure, hypersensitivity to cold or cold allergy, circulatory disorders, a tendency towards thrombosis, acute infections, skin conditions or open wounds. Rubedo Spa is entitled to make the provision of a treatment conditional upon the completion of a medical history form and the provision of written consent.
- Rubedo Spa is entitled to adapt, postpone or refuse a treatment in a professional manner if health or safety reasons so require. In the event of known contraindications — in particular for whole-body and local cryotherapy (including, amongst others, untreated high blood pressure, severe cardiovascular diseases, pregnancy, cold allergy, open wounds, Raynaud’s syndrome) — the treatment cannot be administered.
- No guarantee is given for a specific cosmetic outcome; the result depends on the client’s individual physical condition as well as their full and truthful cooperation.
- Rubedo Spa’s liability is unlimited in cases of wilful misconduct and gross negligence, as well as in the event of injury to life, limb or health. In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence, liability is limited to foreseeable damage typical for this type of contract; otherwise, liability for slight negligence is excluded.
§ 7 Genome-based analyses, saliva samples and bespoke products
- Purpose and scope. Genome-based analyses are offered exclusively for cosmetic and wellness purposes. They do not constitute genetic testing for medical purposes within the meaning of the German Genetic Diagnostics Act (GenDG) and are not intended to diagnose, predict or treat diseases or health conditions. No diagnosis, assessment of disease risk or treatment recommendation is provided. Medical enquiries should be directed to a doctor.
- Legal age and capacity to consent. The analysis is carried out only for individuals aged 18 or over who have the capacity to consent and who give consent on their own behalf. Analyses for third parties, for minors or without the individual being physically present during sample collection are not permitted.
- Information and written consent. A personal consultation takes place before the sample is taken: the purpose and scope of the analysis, the type of characteristics assessed, the recipient of the sample, storage and disposal. The analysis will only commence once we have received your written consent. Consent may be withdrawn in whole or in part at any time without giving reasons; the date on which we receive the withdrawal is decisive.
- Right not to be informed. You may at any time state that you do not wish to be informed of individual or all results. In this case, the results in question will not be communicated or discussed.
- Recipients of the sample and analysis. The saliva sample is forwarded for analysis to a contractual partner and a laboratory commissioned by that partner. Rubedo Spa itself carries out no laboratory analysis. We name the recipients to you in the information consultation and in the written consent. Scope, legal basis and the transfer to Switzerland are described in the privacy policy.
- Storage and destruction of the sample. The saliva sample will be used exclusively for the agreed analysis and will be destroyed once this purpose has been fulfilled. It will only be stored for subsequent, non-agreed analyses at your express request. If you withdraw your consent before the analysis is completed, the sample will be destroyed immediately.
- Results and active participation. The analysis describes predispositions, i.e. tendencies. It does not predict a specific outcome for any individual case. No specific cosmetic success is guaranteed; this depends on your individual circumstances and your active participation. The resulting recommendations regarding skincare, nutrition and lifestyle are sensible conclusions, not medical instructions.
- Timeline. There is a gap of several weeks between the sample being taken and the report being available; your personal report will then be processed. Duration estimates are approximate. Delays in the laboratory or during dispatch for which we are not responsible do not constitute grounds for cancellation or a reduction in price, provided that the service is delivered within a reasonable timeframe.
- Prices and payment. Analysis, bespoke natural cosmetics and individually formulated micronutrients are invoiced before production begins or before the sample is sent off. Two invoices may be issued: one for the studio’s services, and one for the analysis and products.
- Right of withdrawal for distance contracts. If the contract is concluded by means of distance selling, Section 5 of these General Terms and Conditions applies. In the case of analysis as a service, the right of withdrawal expires once we have fully performed the service and you have expressly consented to this before the service begins and confirmed your awareness of the expiry of the right of withdrawal (Section 356(4) of the German Civil Code (BGB)). In the case of products custom-made to your profile, the right of withdrawal expires upon commencement of manufacture (Section 312g(2)(1) of the German Civil Code (BGB)). Samples already sent to the laboratory cannot be retrieved; the analysis fee is non-refundable once the samples have been received by the laboratory.
- Prohibition of discrimination. The results of genome-based analyses are not disclosed to third parties — in particular not to employers or insurance companies — and we neither request nor accept such information.
§ 8 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy, which forms an integral part of these Terms and Conditions.
§ 9 Applicable law and jurisdiction
- German law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
- In the event of disputes with consumers, we aim to reach an amicable resolution. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded. To exercise your right of withdrawal, you must inform us (Monica Galletti, Rubedo Spa, Marienstraße 58, 32427 Minden, info@rubedo-spa.de, +49 571 78343423) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.
Exceptions to the right of withdrawal
The right of withdrawal ceases to apply to bespoke products (Section 312g(2)(1) of the German Civil Code (BGB)), as soon as production has commenced and you have given your express consent — this includes natural cosmetics manufactured according to your genetic profile and individually formulated micronutrients. In the case of services — including genome-based analysis and its evaluation — the right of withdrawal expires once we have fully performed the service and you have expressly consented prior to the commencement of the service and confirmed your awareness that you will lose your right of withdrawal upon full performance of the contract (Section 356(4) of the German Civil Code (BGB)). A saliva sample that has already been sent to the laboratory cannot be retrieved. For vouchers agreed in person and on-site (in-store purchases), there is no right of withdrawal in accordance with Section 312b(1) of the German Civil Code (BGB).
